1. Parties and subject

AW has compiled this Privacy Policy, which aims to inform Users in a transparent manner about the website hosted at the following address: thegreattransformation.eu(referred to hereinafter as the ‘Site’), and the way in which personal data is collected and processed by AW.

The term ‘User’ refers to any user, whether a natural or a legal person, who visits the Site or communicates with the Site in any way.

In this capacity, AW determines all technical, legal and organisational means and purposes for processing the personal data of Users. AW undertakes to implement all necessary measures to ensure that the processing of personal data takes place in accordance with the Law of 30 July 2018 on the protection of individuals with regard to the processing of personal data (hereinafter referred to as the ‘Law’) and Regulation (EU) 2016 679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the ‘Regulation’).

AW is free to choose a natural or legal person who processes the personal data of Users at its request and in its name (hereinafter referred to as the ‘Subcontractor’). Where appropriate, AW undertakes to select a Subcontractor that provides sufficient guarantees regarding the technical and organisational security measures for processing personal data, in accordance with the Law and the Regulation.


2. Processing personal data

Use of the Site by Users may lead to the disclosure of personal information. The processing of this data by AW, in its capacity as Controller or by service providers operating in the name and on behalf of AW, shall be carried out in accordance with the Law and the Regulation.

3. Purpose of the personal data processing

In accordance with Article 13 of the Regulation, the purposes of the personal data processing shall be communicated to the User and are as follows:

To receive the AW newsletter, attend AW events, make an appointment, share content.


4. The personal data that may be processed

The User agrees that when he/she visits and uses the Site, AW shall collect and process, in accordance with the terms and principles set out in this Privacy Policy, the following personal data:

The information provided by Users to enable the proper execution of mutual obligations (mainly surname, first name, e-mail address).


5. Consent

By accessing and using the Site, the User declares that he/she has read and granted his/her free, specific, informed and unambiguous consent for the processing of his/her personal data. This agreement relates to the content of this Privacy Policy.

Consent is granted by the positive action the User takes by checking the privacy policy box in the hypertext link. This consent is an essential condition for performing certain actions on the Site or to enable the User to enter into a contractual relationship with AW. Any agreement that connects AW and a User with respect to the services and goods offered on the Site is subject to the User's acceptance of the Privacy Policy.

The User agrees that, in accordance with the terms and principles set out in this Privacy Policy, the Controller shall collect and process his/her personal data that he/she supplies on the Site or in connection with the services provided by AW, for the purposes mentioned above.

The User has the right to withdraw his/her consent at all times. The withdrawal of consent shall be without prejudice to the legality of processing on the basis of prior authorisation.


6. Retention period of User personal data

In accordance with Article 13(2) of the Regulation and the Law, the Controller shall only keep personal data for as long as reasonably necessary to achieve the objectives for which they are processed.

In all cases, this duration is less than: one year.


7. Recipients of data and disclosure to third parties

Personal data may be passed on to employees, co-workers, subcontractors or AW suppliers who provide adequate guarantees for the security of the data and who cooperate with AW in marketing products or providing services. They act under the direct authority of AW, and are responsible for collecting, processing or outsourcing this data.

In all cases, the recipients of the data and those to whom the data has been provided comply with the content of this Privacy Policy. AW ensures that they only process this data for the intended purposes and in a discreet and secure manner. In the event that the data is disclosed to third parties for direct marketing purposes or business development, the User will be informed in advance to request his or her consent for the use of his/her personal data.


8. User rights

The User can exercise his/her rights at any time by sending a message by e-mail to the following address: info@architectureworkroom.eu, or a letter by post, accompanied by a copy of his/her identity card to the following address: Leopold II laan 152, 1080 Brussels.

a. Right of access

In accordance with Article 15 of the Regulation, AW guarantees the right of the User to access his/her personal data. The User has the right to access this personal data and the following information:

The categories of personal data concerned;
The recipients or categories of recipients to whom the personal data is or will be provided, in particular recipients established in third countries or international organisations;
Where possible, the proposed retention period for personal data or, if this is not possible, the criteria used to establish this period;
The existence of automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the Regulation, and, at least in such cases, relevant information on the underlying logic, as well as the importance and expected effects of such processing on the data subject.
The Controller may demand a reasonable fee based on the administrative costs for additional copies requested by the User.

If the User submits this request by electronic means (e.g. via the e-mail address), the data shall be provided in electronic format and for general use, unless otherwise requested by the User.

The copy of his/her data will be communicated to the User no later than one month after receipt of the request.

b. Right to rectification

AW guarantees the User the right to have his/her personal data rectified and erased.

In accordance with Article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or erased at any time. The User first makes the necessary changes in his/her User account, unless they cannot be made personally, in which case the request can be addressed to AW.

In accordance with Article 19 of the Regulation, the Controller shall inform any recipient to whom the personal data has been provided of any correction of personal data, unless such rectification proves impossible or requires disproportionate effort. The Controller shall provide the data subject with information on those recipients if requested by the data subject.

c. Right to erasure

The User shall have the right to have his/her personal data erased as soon as possible in the cases referred to in Article 17 of the Regulation.

If the Controller has disclosed the personal data and is obliged under the previous paragraph to erase it, the Controller shall, taking into account the available technologies and the implementation costs, take reasonable measures, including technical measures, to inform other controllers responsible for processing the personal data that the data subject has requested those responsible for processing to delete the link with the personal data or a copy or reproduction thereof.

The two preceding paragraphs shall not apply insofar as processing is necessary:

To exercise the right to freedom of expression and information; to comply with a legal obligation to process under Union or Member State law to which the Controller is subject, or a task in the public interest, or in exercising official authority entrusted to the Controller;
To determine, exercise or in the defence of legal claims.
In accordance with Article 19 of the Regulation, the Controller shall inform any recipient to whom the personal data has been provided of any deletion of personal data or any restriction on its processing, unless such disclosure proves impossible or disproportionately difficult. The Controller shall provide the data subject with information on those recipients if requested by the data subject.

d. Right to restrict processing

The User shall be entitled to restrict the processing of his/her personal data in the cases referred to in Article 19 of the Regulation.

In accordance with Article 19 of the Regulation, the Controller shall inform each recipient to whom the personal data has been provided of any restrictions on the processing carried out, unless such disclosure proves impossible or disproportionately difficult. The Controller shall provide the data subject with information on those recipients if requested by the data subject.

e. The right to data portability

In accordance with Article 20 of the Regulation, Users are entitled to receive their personal data from AW in a structured, widely-used and machine-readable format. Users have the right to pass this information on to another controller without AW preventing it in the cases provided for in the Regulation.

If the User applies his/her right to data portability under the previous paragraph, he/she has the right to have personal data transferred directly from one controller to another, insofar as this is technically possible.

Exercising the right to data portability shall not affect the right to erase the data. This right shall not apply to processing necessary for the performance of a task of general interest or for exercising the public authority assigned to the Controller.

The right to data portability does not affect the rights and freedoms of third parties.

f. Right of objection and automated individual decision-making

The User has the right at all times to object to the processing of his/her personal data because of his/her specific situation, including the automation of data by AW. In accordance with Article 21 of the Regulation, AW will no longer process personal data unless there are legitimate and compelling reasons for processing that prevail over the interests and rights and freedoms of the User, or for the determination, exercise or defence of legal rights.

When processing personal data for business development purposes, the User has the right at all times to object to the processing of the personal data relating to him/her for business development purposes, including profiling insofar as it relates to such purposes.

If the data subject objects to processing for business development purposes, the personal data shall no longer be processed for that purpose.

g. Right of complaint

The User has the right to lodge a complaint concerning the processing of his/her personal data by AW to the Data Protection Authority, responsible for the Belgian territory. More information can be found on the website: www.dataprotectionauthority.be

9. Cookies

The Site uses cookies to distinguish Users of the Site. This makes it possible to provide Users with a better browsing experience and to improve the Site and its content. The objectives and methods related to cookies are included in this article.

a. General principles

A ‘Cookie’ is a file that is temporarily or permanently placed on the User's hard drive when viewing the Site for the purpose of a subsequent connection. Thanks to cookies, the server recognises the User's computer.

Cookies can also be installed by third parties with whom AW cooperates.

Some of the cookies used by AW are necessary for the proper functioning of the Site, others are necessary to improve the User experience.

b. Types of cookies and intended purposes

Different types of cookies are used by AW on the Site:

Technical cookies: these are necessary for the operation of the Site, enabling communication of the data entered, and are intended to facilitate the User's navigation of the Site;
Statistical and audience cookies: these cookies make it possible to recognise a User and are used to count the number of Website Users over a certain period of time. Since they also indicate browsing behaviour, they are an effective way to improve the User's browsing experience by displaying suggestions and recommendations that may be of interest to the User. They also make it possible for AW to identify and correct possible bugs on the Website;
Functional cookies: these cookies facilitate use of the Site by retaining certain entered choices (e.g. username or language);
Tracking cookies: AW uses tracking cookies through Google Analytics to measure User interaction with the Site's content and produce anonymous statistics. c. Retention period for cookies

Cookies are stored for the time it takes to achieve the intended objective. The cookies that can be stored on the User's hard drive and the storage period are as follows:

If the User does not want the Website to place cookies on his/her hard drive, he/she can easily manage or delete them by adjusting his/her browser settings. 10. Limitation of the Controller's liability

The website may contain links to other third-party websites that are not connected to AW. The content of these sites and compliance with the Law and the Regulation are not the responsibility of AW.

The person holding parental authority must give his or her express consent to a minor under the age of 16 to disclose personal information or data on the Site. AW strongly recommends that persons exercising parental authority over minors promote responsible and safe use of the Internet. The Controller cannot be held liable for the collection and processing of personal information and data of minors under the age of 16 whose consent is not effectively covered by that of their legal parents, nor for incorrect data - in particular as regards age - entered by minors. Under no circumstances is personal data processed by the Controller if the User indicates that he/she is under 16 years of age.

AW is not responsible for the loss, damage or theft of personal data, in particular as a result of the presence of viruses or after computer attacks.


11. Safety and security

The Controller shall implement organisational and technical measures to ensure an appropriate level of security for processing and collecting data. These security measures depend on the implementation costs relating to the nature, context and purposes of the processing of personal data.

The Controller uses standard encryption technologies within the IT sector when transferring or collecting data on the Site.


12. Privacy Policy Amendment

AW reserves the right to amend this Privacy Policy to comply with the applicable legal obligations. The User is therefore requested to consult the Privacy Policy regularly to stay informed of any changes and adjustments. Such changes will be posted on the Site or sent by e-mail to guarantee opposability.


13. Applicable law and competent court

This Privacy Policy is governed solely by Belgian law. Any dispute will be referred to the courts of the judicial district of AW’s registered office.
